Privacy

Your use of other web sites operated by DUELEGS SRL or by other companies in the DUELEGS SRL group is subject to the Privacy Rules published on those sites. By accepting the Privacy Rules and the User Agreement at the time of registration, you expressly consent to the use, storage and disclosure of your personal data. These Privacy Rules shall be effective upon acceptance by new users and shall otherwise be effective as of 4 December 2009.

Data controller

By using DUELEGS SRL services, you agree to the following:
DUELEGS SRL is the controller of your personal data;

DUELEGS SRL processes your personal data for the provision of DUELEGS SRL services pursuant to the User Agreement and this Privacy Policy, in accordance with the established principles.

Collection

You can browse our site without revealing your identity or other personal information about you. Once you have provided us with your personal information, you are no longer anonymous to us. If you choose to provide us with your personal information, you consent to the collection and use of that information as  described in this Privacy Policy.

DUELEGS SRL may collect and store the following personal data:

name, email address, address and telephone number, date of birth;
transaction information based on your activities on the site (such as offers, purchases, sales, items and content related to your account);
shipping, billing and other information you provide when purchasing or shipping an item;
messages posted in the Forums, dispute resolution, correspondence through our site and correspondence sent to us;
information gathered from your interaction with our site, services, content and advertising, including computer and connection information, statistics on the number of hits, traffic to and from the site, advertising data, IP address and standard Internet access information;
additional information that we ask you to provide in order to verify the authenticity of your identity or if we believe that you are violating the rules of the site (for example, DUELEGS SRL may ask you to send an ID card or utility bill to verify your address or to answer additional questions online to verify your identity or ownership of an item you have offered for sale); alternatively, DUELEGS SRL may use other lawful means to collect information in order to verify your identity;
information acquired from other companies, such as demographic data and date of browsing; additional information provided by you.

 

Marketing

DUELEGS SRL does not sell or give your personal data to third parties for marketing purposes without your explicit consent. We may associate your data with information we collect from other companies and use it to improve and personalise our services, our content and our advertising. If you do not wish to receive commercial communications from DUELEGS SRL or participate in our advertising customisation programmes, simply indicate your preference to opt-out or follow the instructions provided in the communication or commercial message.

Use

DUELEGS SRL collects your personal data primarily to provide you with a secure, smooth, efficient and personalised service.

You authorise DUELEGS SRL to use your personal data for the following purposes:

to provide services and customer support at your request;
resolve disputes, collect fees and settle problems;
prevent potentially prohibited or unlawful activities and enforce our User Agreement; customise, measure and improve our services, content and advertising;
informing you of our services and those of other companies in the Group, sending you commercial communications, service updates and promotional offers based on your communication preferences;

and comparing the accuracy of data and verifying it with third parties.

Scope of communication of your personal data

DUELEGS SRL may disclose personal data to respond to legal requests, enforce our rules, respond to complaints that an advertisement or other content violates the rights of others or to protect the rights, property or safety of anyone.

DUELEGS SRL may share your personal data with:

other companies in the Group to offer joint content and services (such as registration, transactions and customer support), to help detect and prevent potentially unlawful activities and to guide decisions about products, services and communications. Other Group companies will use this information to send you marketing communications only if you have requested their services;

service providers with whom we have a contractual relationship and who collaborate in our business activities (such as fraud investigations, invoice collection, affiliate and incentive programmes and co-branded credit cards);

other third parties to whom you expressly request that DUELEGS SRL send your personal data (or about whom you have otherwise received express notice and to whom you consent when using a specific service);

police forces or other public authority officials, to respond to a request relating to a criminal investigation or an alleged illegal activity. In such cases, DUELEGS SRL will disclose the information and data necessary to carry out the investigation, such as name, city, postcode, telephone number, email address, user ID history, IP address, fraud complaints and history of offers and advertisements;

parties participating in the Verification of Proprietary Rights Programme (VeRO) bound by a confidentiality agreement, under the terms in which DUELEGS SRL, at its own discretion, deems necessary or appropriate to carry out investigations or inquiries relating to the commission of fraud, computer fraud, infringement of intellectual property rights, acts of hacking or other illegal activities. In such cases, DUELEGS SRL will disclose the name, address, city, postcode, country, telephone number, email address and company name;

other companies, in the event of a merger or acquisition between DUELEGS SRL and the company in question (in which case, DUELEGS SRL will require the new company to process your personal data in accordance with these Privacy Rules. In the event that your personal data is used in a manner that does not comply with these rules, you will receive prior notice to that effect).

Notwithstanding the foregoing, in order to respect your privacy and preserve our ability to prevent malicious persons from accessing the Community, we will not disclose your personal information to law enforcement agencies, public officials and other third parties without verifying the existence of a subpoena, court order or substantially similar legal process, except where we believe in good faith that disclosure is necessary to prevent imminent physical harm or financial loss or to report suspected illegal activity.

Sharing your data on DUELEGS SRL
If you access our site from a public computer or from a computer in an Internet Point, some of your information may be visible to others who use the computer after you. After using a public computer, we encourage you to log out of DUELEGS SRL and delete cookies.

 

Use of data provided by DUELEGS SRL

DUELEGS SRL allows you to share personal data and financial information for the purpose of completing transactions. We encourage you to disclose your privacy practices and to respect the privacy of other users. DUELEGS SRL cannot guarantee the privacy or security of any information you choose to share, so we recommend that you evaluate the privacy and security policies of those with whom you intend to transact business before entering into a transaction and choosing to share personal information. To protect your privacy, we allow only limited access to contact information, shipping information, and users' financial information to facilitate your transactions. When users are engaged in a transaction, they can
access each other's names, user IDs, email addresses and other contact and shipping information. In all cases, you must comply with data protection regulations and give other users the opportunity to request deletion of their names from your database and to check what information and personal data you have collected about them.

You agree to use user information exclusively for the following purposes:

for purposes related to transactions on the site other than unsolicited commercial communications;
for the use of services offered through the site (e.g. escrow, insurance, shipping and fraud claims) or other purposes expressly indicated by a user.

Cookie

DUELEGS SRL uses "cookies" (small files saved on your hard disk) on some pages of the site in order to analyse access to web pages, personalise its services, content and advertising messages, measure the effectiveness of promotions and ensure trust and security. For more information on the use of

Here is some important information on cookies:
DUELEGS SRL offers functionalities that are only available through cookies;
The use of cookies enables DUELEGS SRL to identify you and prevents you from repeatedly entering your password;
DUELEGS SRL mainly uses cookies, which are automatically deleted at the end of each login session;
you can always and freely refuse cookies, but in this case you may not be able to use certain DUELEGS SRL services or sites;
you may find cookies placed by third parties on certain pages of the site over which we have no control (e.g. when you view a webpage created by another user, there may be a cookie saved by that specific webpage).

Prohibition of spamming, spyware or counterfeit e-mails

DUELEGS SRL and its users do not tolerate "spamming", i.e. the unwanted and unsolicited sending of commercial and advertising material and information. Please be sure to set your email communication preferences so that we can communicate with you as you prefer. We encourage you to report spamming or counterfeit e-mails to DUELEGS SRL by sending an e-mail to info@duelegs.com. Sending commercial and/or advertising e-mails or in any case content that violates our User Agreement is prohibited. DUELEGS SRL carries out an automatic check of messages and may use manual filters to check for spamming, viruses, attempts to acquire personal data, to carry out other illegal activities or to transmit illegal or forbidden content, but does not permanently archive messages sent through these tools. If you send an email to an address that is not registered in the Community (through Send to a Friend or other tools), DUELEGS SRL does not permanently store the email you send, nor does it use the email address for marketing purposes, nor does it sell or give away such email addresses for compensation.

Account Protection

Your password is the only "key" that allows you to access your DUELEGS SRL account. Use complex numbers, letters and special characters and do not disclose your password to third parties. If you decide to provide your password or personal information to a third party, you will be liable for all acts carried out with the use of your account. If you lose control of your password, you may no longer be able to control the use made of your personal information and be subject to legally binding actions taken on your behalf. Therefore, if for any reason your password has been compromised, we recommend that you notify DUELEGS SRL and change it immediately.

Access, control and modification of your personal data
You can see, check and change much of the data saved in your DUELEGS SRL profile at any time. In general, DUELEGS SRL will not modify your personal information manually as it is very difficult to verify your identity remotely. We encourage you to update your data promptly in the event of changes or
inaccuracies. After posting, you can no longer modify or remove published messages. DUELEGS SRL will close your account and delete your personal information as soon as reasonably practicable upon your request to Customer Support based on your account activity and in accordance with applicable law. DUELEGS SRL retains personal information associated with closed accounts to comply with applicable laws, prevent fraud, collect any outstanding fees, resolve disputes and problems, assist with investigations, enforce the DUELEGS SRL User Agreement, and take other actions as required by law. Security

Your data is stored on our servers. DUELEGS SRL treats data as an asset to be protected and uses numerous tools (encryption, passwords, physical protection, etc.) to protect your personal data from unauthorised access and disclosure. However, you should be aware that third parties may unlawfully intercept or access transmissions or private communications, and other users may unlawfully or improperly use your personal data collected by the site. We make every effort to protect your privacy, but we cannot promise that your personal information or private communications will always remain confidential.

Third parties

Except as expressly stated in these Privacy Rules, this document refers only to the use and disclosure of data provided directly by you. If you communicate your personal data to others (bidders, buyers or sellers) on our site or on other Internet sites, the use and disclosure of the data you communicate may be subject to other rules. DUELEGS SRL does not control the privacy policies of third parties and you are subject to the privacy policies of such third parties if applicable. We encourage you to inquire about them before disclosing your personal data to others.

 DUELEGS SRL may change the content of these Privacy Rules at any time by publishing the new version on its site. All new terms and conditions shall be effective 30 (thirty) days from the date of publication.
